Compliance
Compliance risks result when an organisation fails to be aware of or satisfy legal and regulatory requirements. These may be related to many of the above areas but are so important that they need to be considered separately.
When considering risks associated with this area you should look at the following (this is not an exhaustive list, consideration of compliance issues needs to be specific to each individual organisation, and the following is a guide only):
a) your objects and powers in your governing document
b) internal policies and procedures
c) obligations to funders and stakeholders
d) legal agreements and contracts
e) legislation such as trust law, tax law, VAT relief for charities, health and safety, fundraising, child protection, intellectual property law, charity law, equal opportunities, data protection, employment law, company law, criminal law and common law.
